OpenPolicy’s Advocacy on behalf of the CISO Community impacting SEC v. SolarWinds and Tim Brown decision, Amicus Brief quoted by the Court

A significant milestone was achieved in the ongoing efforts to protect the CISO community. U.S. District Judge Paul Engelmayer dismissed most of the SEC’s complaint against SolarWinds and its CISO, Tim Brown. This victory is a testament to the power of collaboration and the combined expertise of legal and technical professionals in the cybersecurity field.

We had the privilege of working alongside Emily Coyle and legal experts Andrew Goldstein, Josef Ansorge, and Matt Nguyen at Cooley LLP and Timothy Howard at Freshfields Bruckhaus Deringer to support the development of an Amicus Brief supported by dozens of leading CISO, ultimately impacting the court decisions. Special thanks to Robert Rodriguez at SINET, who helped mobilize the CISO community.

The CISO amicus brief played a crucial role in the court’s decision, demonstrating the impact we can make when we unite and leverage our diverse networks and areas of expertise. Arguments from our brief were prominently featured in the court’s dismissal order, underscoring the importance of our collective efforts.

However, the journey is far from over. There remains significant policy work to be undertaken with Congress, the White House, and regulatory agencies.

We extend our deepest gratitude to everyone who contributed to this effort. Your dedication and expertise are invaluable as we continue to advance cybersecurity policy!
